1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Ghana Realty Connect's website, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using our Services under the laws of Ghana or any other applicable jurisdiction

3. Account Registration

To access certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete.

4. User Responsibilities

When using our Services, you agree NOT to:

  • Post false, misleading, or fraudulent property listings
  • Violate any local, national, or international laws
  • Infringe on the intellectual property rights of others
  • Transmit viruses, malware, or other harmful code
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to our systems
  • Use automated systems (bots, scrapers) without permission
  • Impersonate any person or entity
  • Engage in any activity that disrupts or interferes with our Services

5. Property Listings

5.1 Listing Accuracy

Property owners and agents are responsible for ensuring that all information in their listings is accurate, current, and complete. This includes property details, pricing, photos, and legal documentation.

5.2 Verification Process

Ghana Realty Connect manually verifies all property listings. However, we do not guarantee the accuracy or completeness of any listing. Users should conduct their own due diligence before entering into any transaction.

5.3 Content Ownership

By submitting a property listing, you grant Ghana Realty Connect a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your listing content on our platform and marketing materials.

6. Transactions and Payments

Ghana Realty Connect facilitates connections between property owners and seekers but is not a party to any transaction. We do not:

  • Guarantee the completion of any transaction
  • Act as an escrow service or hold funds
  • Provide legal, financial, or real estate advice
  • Warrant the quality, safety, or legality of any property

All transactions are the sole responsibility of the parties involved. We strongly recommend engaging qualified professionals (lawyers, real estate agents, surveyors) for any property transaction.

7. Fees and Charges

Ghana Realty Connect may charge fees for certain services, including:

  • Featured property listings
  • Premium account features
  • Transaction facilitation services

All fees will be clearly disclosed before you incur them. We reserve the right to modify our fees with advance notice.

8. Intellectual Property

All content on Ghana Realty Connect, including text, graphics, logos, images, and software, is the property of Ghana Realty Connect or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Non-infringement of third-party rights
  • Accuracy, completeness, or reliability of content
  • Uninterrupted or error-free service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHANA REALTY CONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Property damage or personal injury
  • Failed transactions or disputes between users
  • Unauthorized access to your account

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Ghana Realty Connect, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit to our platform

12. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, with or without notice. You may also terminate your account at any time by contacting us.

Upon termination, your right to use our Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ghana. Any disputes arising from these Terms or your use of our Services shall be resolved through:

  • Good faith negotiations between the parties
  • If negotiations fail, arbitration in Accra, Ghana
  • Courts of Ghana as a last resort

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our Services after changes become effective constitutes your acceptance of the revised Terms.
